Methods of Alternative Dispute Resolution

MEDIATION - is a voluntary, consensual decision making process, where a neutral third party facilitates communication and assists the parties in identifying concerns, improving communication, exploring potential outcomes. Points of agreement are documented in a Memorandum of Understanding.

ARBITRATION - is a scaled down trial. A neutral third party hears testimony and considers evidence prior to rendering a decision on the matters presented. The arbitrator's award (decision) may be binding or non-binding based on the prior agreement or contract between the parties.

OMBUDSMAN - is an independent party that gathers information, based on specific concerns raised. The ombud has access to information and key decision makers within an organization. The Ombud does not advocate for a specific party, rather they present information to decision makers allowing for a more informed decision, based on facts and fairness.

FACILITATION - is an independent person that manages a group process or meeting. The facilitator brings focus and clarity to issues, draws upon the strengths of the group, and solicits input form the group in order to develop a clear plan of action. It creates group synergy and develops buy in to group projects.

NEGOTIATION - is a voluntary, consensual decision making process, where two or more parties discuss issues and bargain in an effort to resolve the issues presented.
